GENERAL SALES CONDITIONS

1. OFFERS
   Our offers are by way of information only and without any engagement.
   
   
2. DELIVERY TIMES
   They are always approximately. The delay in delivery doesn’t give the right for any compensation in favour of our customer. The delivery will be carried out with consignment at the carrier, even if we have eventually assumed the obligation of goods delivered free of charge.
   
   
3. MISSING OR DEFICIENCY OF GOODS
   On the Italian market of raw materials, the deficiency of labour, suspension even partial of transports, fire, strikes, extreme climate events are considered cases of circumstances beyond one’s control. In these cases like in every other accidental case or of circumstances beyond one’s control, the delivery will be automatically postponed for a time equal to the duration of the cause determined by the postponement.
   
   
4. CONTROL
   All our articles are accurately controlled and tested before shipment. Our warranty is limited to repairs at our workshops or to replacement of those parts that are defected due to construction or material quality within three months after date of invoice, excluding any compensation. The damaged parts or pieces have to be returned upon charge of our contractor to our address and they will be replaced or repaired in the shortest possible time and returned ex-works. The assembling of those pieces is upon charge of our contractor. This warranty stops when the customer didn’t observe the established payment conditions or if he forced or repaired the material or used it not according to our authorizations or instructions; or the parties established expressively that the buyer renounces whatever request for damage from the beginning. We are not responsible for any damages or accidents that could happen to things or people due to the use or defects of the sold articles.
   
   
5. PRICES/ORDERS
   They are listed on the price-list and the conditions are those ones marked in our orders or offers or of our agents. Being subject of modifications, the prices are only binding after our confirmation, as well as the orders are assumed as reservation.
   
   
6. SHIPMENTS
   The goods are transported on risk and danger of the buyer even if the delivery free of charge has been agreed, in addition to the sales agreement. The goods are not guaranteed against damages for breaking or failure during transport and they aren’t covered by any warranty in any case, if not required formally and upon charge of the buyer. The contractor has to check the arrived goods and forward possible complaints to the related people. The packaging is not included in the price. It will be supplied at cost price and its return won’t be accepted in any case. Complaints which are sent after eight days of arrival of the goods at destination won’t be accepted anymore.
   
   
7. PAYMENTS
   They have to be carried out within the terms and conditions indicated in the offers or in the orders and in any case within 90 days. After that period we are authorized to debit the commercial interests without the need of constitution in arrears. The supplier has the right to suspend the deliveries in case of non-payment of the previous supplies. The court in Novara is competent for any legal dispute. Data, weight and sizes are by way of indication and are not binding. We reserve the faculty to carry out the necessary modifications at any moment and without any notice.
   
   
8. EVERYTHING REGARDING THE ABOVE MENTIONED CONDITIONS
   The above mentioned conditions will be accepted with the underwriting of the order and any condition departing from or not provided for in these conditions will be valid only if agreed in writing.
